Avery’s practice focuses on complex commercial disputes and entertainment litigation, intellectual property, and white-collar criminal defense. Prior to joining Shapiro Arato Bach in September 2021, Avery clerked for a federal appellate judge and worked as an associate at Paul, Weiss, Rifkind, Wharton & Garrison LLP.

Representative Matters

  • Represented prominent rare book dealer in criminal case involving alleged theft of handwritten lyric sheets for the Eagles’ song “Hotel California,” resulting in all charges being dropped mid-trial.
  • Represented recording artist Lizzo in a breach of contract action concerning the COVID-related cancellation of a music festival, resulting in complete victory on summary judgment and full affirmance on appeal.
  • Representing major record company in copyright litigation relating to the unauthorized use of copyrighted sound recordings on social media by fashion retailers.
  • Representing former Goldman Sachs investment banker in his Second Circuit appeal of conviction arising out of the 1MDB scandal.
  • Represented German record label and individual in defamation action brought by musician. After Shapiro Arato Bach filed motions to dismiss, the plaintiff elected to voluntary dismiss all claims against our clients rather than oppose the motions.
  • Represented founder of zero-emission vehicle company in post-trial proceedings and Second Circuit appeal following conviction on securities and wire fraud charges.
  • Represented former CEO of The Federal Savings Bank in Second Circuit appeal of bank bribery conviction arising from loans to Paul Manafort.
  • Represented the former dean of Temple University’s business school in Third Circuit appeal of wire fraud conviction arising from submission of false information to publishers of higher education rankings.
