Ted is an experienced appellate advocate, with two decades of experience representing white collar clients in their federal appeals. He has worked on a wide range of cases, including fraud, tax law, securities, and antitrust, in courts around the country. Ted has argued several federal appeals, and he also maintains an active pro bono practice representing indigent client in state court appeals.

In addition to his work as an appellate attorney, Ted is a tenured law professor at Mitchell Hamline Law School in St. Paul, where he teaches criminal law and evidence. He has published numerous articles in both academic and popular journals.

Representative Matters

  • Representing former Goldman Sachs investment banker in his Second Circuit appeal of conviction arising out of the 1MDB scandal.
  • Represented former dean of Fox Business School at Temple University in Third Circuit appeal of wire fraud convictions arising from alleged submission of false information to U.S. News and other educational rankings publishers.
  • Represented defendant charged with criminal antitrust violations for fixing prices of generic pharmaceuticals; obtained pretrial dismissal of all charges.
  • Represented defendants in Supreme Court in Percoco v. United States and Ciminelli v. United States, resulting in unanimous Supreme Court rulings vacating and remanding their convictions.
  • Argued and won Ninth Circuit en banc appeal in United States v. Nosal, affirming dismissal of multiple charges brought under the Computer Fraud and Abuse Act.
  • Represented Barry Bonds in his Ninth Circuit appeal, resulting in en banc acquittal on only count of conviction; also represented Bonds in government’s interlocutory appeal, and successfully defended exclusion of prosecution evidence.
  • Represented Hamid Hayat in his Ninth Circuit appeal and subsequent Section 2255 proceedings, ultimately obtaining judgment vacating terrorism convictions and exonerating Hayat after over a decade in prison.
  • Argued and won Ninth Circuit appeal in a Section 1983 excessive force case brought by parents of a man killed by Chico, California police officers; Ninth Circuit reversed trial court’s dismissal of the case and remanded for trial.
  • Argued Ninth Circuit appeal on behalf of executive convicted of criminal trademark and copyright violations.
  • Argued Ninth Circuit appeal on behalf of immigrant convicted of federal firearms offenses.
  • Represented former CEO of ArthroCare in his Fifth Circuit appeal of securities fraud convictions, resulting in reversal of all convictions after first trial.
  • Represented AU Optronics in trial proceedings and Ninth Circuit appeal of convictions for criminal antitrust offenses in one of the largest antitrust cases in United States history.
  • Represented Ernst & Young tax partner in his Second Circuit appeal of conviction for promoting tax shelters.
  • Represented Pavel Lazarenko, former Prime Minister of Ukraine, in his Ninth Circuit appeal, resulting in reversal of multiple counts of conviction for corruption.
  • Represented civil defendant in Victaulic v. American Home Assurance Co., resulting in reversal on appeal of largest bad-faith insurance judgment in California history.
  • Argued pro bono numerous cases in Minnesota appellate courts on behalf of indigent defendants.
